Lindsay Lohan in legal trouble again!? This time, though, she appears to be the victim.

Christian LaBella, 25, an aide to GOP U.S. Rep. John Shimkus of Illinois, was arrested on misdemeanor assault and har–assment charges after he had a run-in with LiLo in her Manhattan hotel room.

The New York Daily News says the duo, who met at a club, had a fight when LiLo discovered LaBella had been taking photos of her with his cellphone and e-mailing them to pals. She claims he choked her from behind and threw her to the floor.

"She's very shaken up," her mum, Dina, told the News Sunday. "Thank God he didn't have a weapon." LiLo also may be charged with harassment for her part in the fight.
