Groups challenge regulator on drilling

Two environmental groups on Tuesday sued the Delaware River Basin Commission challenging the regulatory agency's decision to allow five permitted exploratory Marcellus Shale wells to be drilled last year.

Two environmental groups on Tuesday sued the Delaware River Basin Commission challenging the regulatory agency's decision to allow five permitted exploratory Marcellus Shale wells to be drilled last year.

The Delaware Riverkeeper Network and Damascus Citizens for Sustainability asked the U.S. District Court in Trenton to force the wells to be plugged. The DRBC allowed the wells to be drilled despite a moratorium while the agency devised drilling regulations. Exploratory wells allow the drillers to evaluate the gas-bearing rock, but they were not hydraulically fractured.
