Resident challenging SW Pa. county’s turbine law

UNIONTOWN, Pa. - A resident is suing a southwestern Pennsylvania county for an ordinance that makes it easier for companies to erect wind turbines on certain types of property.

UNIONTOWN, Pa. - A resident is suing a southwestern Pennsylvania county for an ordinance that makes it easier for companies to erect wind turbines on certain types of property.

Thomas Bozek's lawsuit targets recent amendments passed by the Fayette County Commissioners. The amendments now allow wind turbines on land zoned for agriculture and industrial uses, which means energy companies no longer need to seek prior approval from the county's zoning board.

Bozek's lawsuit says the amendments weren't properly advertised or described before the county planning commission gave preliminary approval to them in April. The county commissioners ratified the changes in separate votes last month and on Thursday.

Bozek believes 24 turbines planned for a tract in Georges Township are too close to his home.
