The 59-year-old woman accused of bashing MTV and movie celebrity Brandon "Bam" Margera in the head was held for trial this afternoon.
Elizabeth Ray, a neighbor of The Note, Margera's West Chester nightspot, appeared before Magisterial District Judge Gwenn S. Knapp in West Chester.
After listening to testimony from two prosecution witnesses, Margera and Tammy Palumbo, one of the people with Margera at the time of the 2 a.m. June 12 incident, Knapp said charges of aggravated assault and related offices would move to Chester County Court.
Police said they responded to the unit block of South Matlack Street on June 12 and found Margera, 30, lying in the street and bleeding from a wound on the left side of his head. Margera, who skateboarded to fame on MTV's Jackass, a venue for stupid-human tricks, was taken to Crozer Chester Medical Center.
Margera and Palumbo both testified that they were waiting for a ride from "a designated driver" when Ray started yelling from inside her house on Matlack Street. Margera, who later said he and Ray had tangled before over noise from the club, testified that they both exchanged obscenities in a shouting match.
He said that he thought the argument had ended and that he started walking with Palumbo toward his ride when "I just fell to the ground in a pool of blood."
Palumbo testified that she saw Ray holding a long pipe-like object and heard her screaming, "That's right: I'll hit you again."
Margera testified that he sustained a concussion and a laceration that required two staples. He received permission a day later to fly to Los Angeles for the filming of his Jackass 3-D movie, but he had to rewrite parts of the film to avoid receiving additional hits to the head.
"That's a bummer," he said after the hearing, pointing out that there's a huge difference between his stunts and Ray's actions.
"I might get whacked with a yoga ball," he said. "A baseball bat to the head can kill you."
