Dan Gross | Cutler, Malpass blow-by-blow

JUST WHEN you thought the lengthy and venom-filled divorce battle between gazillionaire developer David Cutler and Action News anchor Monica Malpass was over, there's another lawsuit.

JUST WHEN you thought the lengthy and venom-filled divorce battle between gazillionaire developer

David Cutler

and Action News anchor

Monica Malpass

was over, there's another lawsuit.

Cutler sued Malpass and her lawyers Bob Whitehead, of the Obermayer firm in Center City, and Jeannie Fridey, of Jenkintown's Graff & Associates in Montgomery County Court, alleging they buried evidence that a 2002 drug test indicating that Cutler had used cocaine was inaccurate.

The suit alleges that National Medical Services, of Willow Grove, told the attorneys in January 2007 that the 2002 test, conducted as part of a child-custody hearing, was a false positive and provided an updated document, which the attorneys and Malpass did not present to the court at a custody hearing earlier this year. Instead, the suit asserts, they demanded Cutler be retested for drugs on the spot in the ongoing custody battle over the thankfully now-divorced couple's son. Calls to Whitelaw and Malpass were unreturned yesterday, but Clifford Cohn, who represents Fridey and Graff & Associates founder Caron Graff says his "clients are outraged by these meritless claims."

"It's a threat to the entire justice system when someone with unlimited sums of money can threaten lawyers just because they are zealously and succesfully representing their clients," Cohn said. Reached yesterday, Cutler's attorney Paul Rosen said all he had to say about the case is contained in the lawsuit.

* In other 6ABC news, Bernie Prazenica was named yesterday as president and GM of WPVI, aka 6ABC. He replaces Rebecca Campbell, who left town recently to run New York's WABC.

It's not Kane on Krancer ads

No, that is not CN8's Larry Kane doing the voiceover on the Mike Krancer commercials the Republican State Supreme Court candidate had been airing.

"I would never do a campaign commercial - that would shatter my credibility," the veteran newsman told us yesterday as he prepared to call election returns on KYW Newsradio 1060.

Kane had heard from a few friends who thought it might be him on the ads, which he doesn't think sounded much like him.

He did however record his own book, "Ticket to Ride," in audio form, available on iTunes. Kane's CN8 show, "Voice of Reason," airs at 9:30 p.m. Sundays.

Milou: The show must go on

The Rittenhouse Plaza Co-Op Board has threatened to evict artist Perry Milou from his Galleria 1903 (1903 Walnut) if he goes through with "Red Hot: The Art of Sensuality and Sexuality," a four-day exhibit tomorrow through Sunday. Milou's "absolutely" going ahead with it.

"They have no balls," he told us yesterday. "They're just trying to bully me. They have no grounds to evict me," he said. For info on the event visit nsquaredproductions.com.

Dinner with 'Style' delayed

Philadelphia Style magazine's annual Dinner with Style benefit has been postponed until Jan. 29 and will be held at the Hyatt Regency Penn's Landing. The party was scheduled for Nov. 13 at Sherman Mills in East Falls but the Fire Department refused to grant a permit allowing the propane stoves necessary for cooking stations for 40 local restaurants. Philly Style COO Dana Spain-Smith is also chairwoman of the Philadelphia Animal Welfare Society, which the event benefits. For tickets, visit phillypaws.org or phillystylemag.com.

Lynam's labor delays her labor

Dei Lynam is devoted. After the Comcast SportsNet reporter's water broke Oct. 30, she filed a report from Sixers practice before heading to the hospital to deliver a son, Beau. Beau, the second child for her and husband Tim Riviere, is named for Dei's late uncle, Jim "Bo" Boyle, who played ball at West Catholic and St. Joe's with her dad, Jimmy Lynam, assistant coach of the Sixers.

Out and about

Philadelphia Soul co-owner Jon Bon Jovi shopped the new men's clothier Bello (131 S. 18th) yesterday. The rocker attracted a fair amount of attention from passersby and graciously signed autographs.

* Sports agent Jerrold Colton caught up with his Cowboys clients Tank Johnson, Anthony Henry and Pat Watkins over dinner at Capital Grille Saturday night.

* Voice of the Eagles Merrill Reese and wife Cindy joined Kathy Davis of NFL Films and the Cowboys broadcasters for dinner at Mia Sogno (15th & Oregon) the night before the game. *
