Judge orders hearing on Cosby's latest challenge

A Montgomery County judge scheduled a July 7 hearing on Bill Cosby's latest bid to have his sexual assault case dismissed.

A Montgomery County judge scheduled a July 7 hearing on Bill Cosby's latest bid to have his sexual assault case dismissed.

Judge Steven T. O'Neill set the date after a closed-door meeting Tuesday with prosecutors and Cosby's defense lawyers.

He also gave the district attorney's office until June 20 to file a response to Cosby's latest argument - that he was denied his right to confront his accuser because prosecutors failed to call Andrea Constand as a witness at his preliminary hearing last month.

Lawyers on both sides declined to comment as they left the meeting with the judge.

Cosby's team has lost prior bids to dismiss the charge of aggravated indecent assault stemming from a 2004 incident with Constand at his home. The 78-year-old entertainer is free on $1 million bail while he awaits a trial date.
