Bartender's lawyer says N.Y. firm runs McFadden's

In a court filing Wednesday, a lawyer for the bartender alleging racial discrimination at McFadden's Restaurant & Saloon offered "newly discovered facts" intended to show that a New York firm is in charge of the popular Old City bar and that it has a racist national policy.

In a court filing Wednesday, a lawyer for the bartender alleging racial discrimination at McFadden's Restaurant & Saloon offered "newly discovered facts" intended to show that a New York firm is in charge of the popular Old City bar and that it has a racist national policy.

The case is scheduled for a hearing in federal court on Thursday.

The latest filing on behalf of Michael L. Bolden quotes from depositions in a Kentucky lawsuit involving a restaurant reportedly owned by East Coast Saloons, which the lawsuit in Philadelphia says is the parent company of McFadden's at 461 N. Third St.

A court response filed Tuesday by the bar's lawyer asserts that East Coast Saloons is not the parent company and "does not own, control, or manage McFadden's."

Bolden seeks to have his lawsuit certified as a class action involving all of East Coast Saloons' establishments. If East Coast Saloons is dismissed as a defendant, the lawsuit will be against only the one bar.

Bolden's new filing says a business-reporting service identifies John L. Sullivan, a principal of East Coast Saloons, as a principal of Miriam's Kids, the corporate name of McFadden's on Third Street.

Harry Hayman, who has identified himself as director of operations for Miriam's Kids, is also listed as an owner, officer, or director of operations for at least eight other restaurants associated with East Coast Saloons, Bolden's filing says.
