FBI absolves agent in killing of colleague in N.J.

NEWARK, N.J. - An FBI agent who mistakenly shot and killed a colleague a year ago during a bank-robbery stakeout was within the bureau's guidelines for firing his weapon, a spokesman said yesterday.

An internal investigation determined that the actions of the unidentified agent who shot Barry Lee Bush outside a PNC Bank branch in Readington fell within rules governing the use of deadly force, Agent Sean Quinn said.

After an investigation by the FBI's Office of Professional Responsibility, the unidentified agent still could face punishment, ranging from a reprimand to termination.

Yesterday, the building that houses the FBI's New Jersey headquarters was renamed for Bush, 52, who lived and a plaque commemorating him was unveiled in its lobby. Bush, who lived near Easton, Pa., graduated from Pottstown High School in 1972 and served with the Boyertown and Pottstown police before becoming an FBI agent.
