Lincoln U. student arrested in fatal '11 crash

A Lincoln University student and member of the baseball team has been arrested in a 2011 alcohol-fueled crash that killed one man and seriously injured another, the Chester County District Attorney's Office announced Thursday.

Phillip Daniel Tomsic, 22, of Grand Junction, Mich., was charged with homicide by vehicle while DUI, aggravated assault while DUI, and related charges, the office said in a statement.

According to court documents, Tomsic and two friends had been drinking and then decided to go out for food on Nov. 4. Tomsic borrowed a friend's car.

Tomsic, a criminal justice major, was allegedly driving in excess of 85 m.p.h. when he lost control of the car in the area of Ashmun Avenue and Dickey Lane and crashed into a tree. The car caught fire.

Anthony Washington, 22, a passenger, was killed. Kadeem Fulmore, 22, was pinned in the burning car and critically injured. Fulmore suffered severe burns over a large portion of his body; his right foot and left leg below the knee were amputated.

Tomsic was able to crawl from the car. His blood alcohol at the time was 0.089, in excess of the legal limit, according to the District Attorney's Office. - Mari A. Schaefer
