A federal judge in California promised to rule quickly on yesterday's hearing over whether to ban Samsung Android phones that rely on stolen Apple iPhone technology.
Rutgers Law professor and antitrust expert Michael Carrier's predictions:
1. Samsung will not be successful in its attempt to obtain a new trial based on claimed misconduct of the jury foreman.
2. Judge Koh might block the sale of some Samsung phones. (For example) although 17 out of 20 Samsung phones at issue in the case are no longer on the market, there are still 77,000 Galaxy S II phones at retailers.
3. Judge Koh could reduce Apple’s billion-dollar damages award by tens of millions based on incorrect calculations for a few of the phones.
4. The case will be appealed to the Federal Circuit.
