N.Y. man wanted in South Street assault surrenders

The man wanted for assaulting two women in Philadelphia - including one who was critically injured when she jumped out of her third-floor apartment to escape him - has been arrested in New York City.

Philadelphia police announced yesterday that the suspect, David Rosario, 34, is in custody in New York and is expected to waive extradition and return here to face charges.

Capt. John Darby, head of the city police department's Special Victims Unit, praised New York cops for assisting in the investigation.

"This just shows that no matter where the defendant flees, we're going to get you," he said. "We're going to take you off the street."

The injured woman, 31, police said, was raped at knifepoint and suffered extensive injuries when she hit the South Street sidewalk after leaping out of the apartment.

Police said the woman was attacked by a man who was with a group of friends whom she had invited into her apartment after a night of partying at a bar.

Once the bar closed early Monday morning, the attacker went up to her apartment. About 10:30 a.m. Monday, he entered the woman's bedroom and raped her at knifepoint, police said.

Rosario was charged with rape, aggravated assault and related crimes. He also was charged with attempted rape in connection with an assault on a friend of the woman, who wasn't hospitalized. Cops said that that woman is 22 years old.

Darby indicated that Rosario was traced fairly quickly to New York, where his family assisted in efforts to get him to surrender. With his attorney, he gave himself up yesterday. *
